1. Introduction
These Terms & Conditions (“Terms”) govern your use of the SaaS e-invoicing application Fatoorah.Me (the “Service”), owned and operated by Dynamers Private Limited, a company registered in Pakistan (“Company”, “we”, “our”, “us”).
By using the Service, you agree to these Terms.
Governing Law: Islamic Republic of Pakistan.
Note: Users are responsible for complying with applicable laws in the Kingdom of Saudi Arabia, including ZATCA e-invoicing regulations.
2. Eligibility
- You must have the legal capacity to enter into binding contracts.
- You must be at least 18 years old.
- You agree to comply with these Terms.
3. Account Registration
- Provide accurate, complete, and current information when creating an account.
- Keep your account credentials confidential.
- You are responsible for all activity that occurs under your account.
4. User Acknowledgment & Consent
- You acknowledge that you have read, understood, and agree to these Terms & Conditions and our Privacy Policy.
- You consent to your data being stored and processed on servers located in the United States (GoDaddy VPS).
- You accept responsibility for complying with applicable Saudi laws, including ZATCA e-invoicing regulations.
5. Service & Subscription
- The Service includes invoicing, customer and product management, PDF/email invoices, and reporting.
- Subscription: SAR 50/month for up to 300 invoices per month.
- All features are included; no tiered plans are offered.
- Payments are processed securely via third-party payment providers.
- Subscription fees are non-refundable.
- Fees for exceeding the included invoice limit may apply if mutually agreed.
6. Customer Cancellation
- You may cancel your subscription at any time.
- Cancellation stops future payments; unused portions of the current billing period will not be refunded.
- Your account remains accessible until the end of the paid billing period.
- You are responsible for exporting or backing up invoices and data prior to account deactivation.
7. Service Discontinuation or Provider Closure
- The Company may discontinue, suspend, or terminate the Service at any time, including in the event of business closure or insolvency.
- We will make reasonable efforts to notify customers at least 30 days in advance via registered email.
- Customers will have the opportunity to export their invoices and account data before deletion.
- After the retention period ([e.g., 30 days]), all user data will be permanently deleted.
- The Company is not liable for refunds of unused subscription periods except where required by law.
8. Data Hosting & Backups
Your data is stored on GoDaddy VPS servers in the United States. Regular backups are performed, but you are responsible for maintaining copies of critical data. Users remain responsible for compliance with applicable Saudi laws regarding data storage and e-invoicing.
9. Intellectual Property
- The Service, software, and documentation are owned by the Company.
- You retain ownership of your uploaded data.
- The Company is granted a limited license to process your data solely to provide the Service.
10. Privacy & Personal Data
Your use of the Service is governed by our Privacy Policy. By using the Service, you consent to the collection, storage, and processing of your data as described therein.
11. Service Availability
We aim to provide continuous service but do not guarantee uptime. Scheduled maintenance may temporarily interrupt access. No refunds are provided for downtime except where required by law.
12. Warranties & Disclaimers
The Service is provided “as is” without warranties. We disclaim all implied warranties, including fitness for a particular purpose. We do not guarantee error-free performance.
13. Limitation of Liability
The Company is not liable for indirect, incidental, or consequential damages. Total liability for any claim arising under these Terms is limited to the subscription fees paid in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless the Company from claims, damages, or expenses arising from:
- Your use of the Service.
- Violation of these Terms.
- Violation of applicable laws.
15. Governing Law & Dispute Resolution
Governing law: Pakistan. Disputes are first resolved amicably and then submitted to the courts or arbitration in Pakistan. Users are responsible for compliance with applicable Saudi laws while using the Service.
16. Changes to Terms
The Company may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
